Notification of an Environmental Authorisation

Project:           Proposed Realignment of A 132 kV Powerline at Vandyksdrift Central (VDDC) Section of the Wolvekrans Colliery

Client:             South32 SA Coal Holdings (Pty) Limited

An Environmental Authorisation (EA)) for the realignment of a 132 kV powerline between the Eskom Kromfontein Substation and the Eskom Klein Substation at the Vandyksdrift Central (VDDC) section which is part of the Wolvekrans Colliery.

The EA was granted on 18 November 2020 by the Mpumalanga Department of Agriculture, Rural Development, Land and Environmental Affairs (MDARDLEA) in terms of the National Environmental Management Act, 1998 (Act No.107 of 1998) (NEMA), as amended and the Environmental Impact Assessment (EIA) Regulations 2014, as amended.

As required by Regulation 4(2) of the NEMA EIA Regulations (as amended), all registered Interested and Affected Parties (I&APs) must be notified of the decision within 14 days of the date of receiving the Department’s decision. As per the EA, we would like to draw your attention to Chapter 2 of the NEMA National Appeal Regulations (Government Notice R993 of 8 December 2014, as amended) which prescribe the appeal procedure to be followed.

Should any party wish to appeal any aspect of the decision, a notice of intention to appeal must be lodged by all prospective appellants with the Member of the Executive Council (MEC) of MDARDLEA within 20 days of the date of the Department’s decision. As the decision by the MDARDLEA was signed and issued on 18 November 2020, the notice of intention to appeal must be submitted to the MEC by 8 December 2020.
